These Terms of Service govern access to the Namorra website and purchases made through it. Namorra is based in Watford, United Kingdom. By using the website or placing an order, you agree to these Terms together with the policies referred to below.
If you do not agree to these Terms, please do not use the website. Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded or restricted.
1. About the store
Namorra operates this online retail store. Shopify provides the ecommerce platform that enables the website and checkout, but your contract for products purchased from the store is with Namorra.
References to “we”, “us” and “our” mean Namorra. References to “you” and “your” mean the person using the website or purchasing from us.
2. Who may use the website
You must have legal capacity to enter into a contract. If you are under the age at which you may contract independently where you live, you may use the website only with the involvement and permission of a parent or legal guardian.
You are responsible for ensuring that information supplied through the website is accurate, current and complete and that any account credentials are kept secure. Notify us promptly if you believe an account or order has been used without authority. Please use our Contact Form.
3. Product information
We take reasonable care to present product descriptions, specifications, images and prices accurately. Screen settings, photography and manufacturing variation can affect the appearance of colour, texture or scale. Measurements and other specifications described as approximate should be treated accordingly.
Product information may be corrected or updated where necessary. A correction will not remove rights that arise if goods supplied to you are not as described, of satisfactory quality or fit for an agreed purpose.
Products must be used lawfully, for their intended purpose and in accordance with applicable safety information and instructions. You are responsible for checking suitability where the website asks you to choose a size, specification, compatibility or other variant.
4. Placing an order and contract formation
Your order is an offer to purchase the items shown at checkout. An automated acknowledgement or payment authorisation confirms receipt of the order but does not, by itself, require us to accept it. Unless we expressly state otherwise, the contract is formed when we confirm dispatch or otherwise expressly accept the order.
We may decline or cancel an order before acceptance where reasonably necessary, including where:
- an item is unavailable;
- payment cannot be authorised or verified;
- delivery cannot be made to the selected destination;
- there is an obvious pricing, description or technical error;
- purchase limits have been exceeded;
- information supplied appears materially inaccurate; or
- fraudulent, abusive, unlawful or suspicious activity is reasonably suspected.
We may also refuse service where legally permitted, including to protect customers, the website or Namorra from misuse. We will exercise these rights reasonably and without unlawful discrimination. If we cancel an order after taking payment, we will reimburse the amount paid for the cancelled item or order without undue delay.
5. Prices and payment
The price, currency, taxes, delivery charge and total payable for an order are displayed during checkout. You authorise the selected payment method to be charged for the amount shown.
If a price is clearly incorrect and the error could reasonably have been recognised, we may reject or cancel the affected order before acceptance. If an accepted order is affected by a pricing error, we will contact you and will not charge a higher price without your agreement. If the order is cancelled, any amount already taken will be reimbursed.
You must use a payment method that you are authorised to use. Payment processing may be provided by third-party payment services under their own terms and privacy notices.
6. Delivery
Available destinations, delivery services and charges are shown during checkout. Our Shipping Policy explains estimated delivery periods, address responsibilities, delays, customs, tracking and transit risk.
Standard delivery is estimated at 3 to 5 business days. Express delivery is estimated at 1 to 2 business days for eligible orders only. These periods are estimates rather than guaranteed dates unless a fixed date is expressly agreed. Statutory rights relating to agreed delivery periods and late delivery remain unaffected.
7. Cancellations, returns and refunds
Our Return & Refund Policy explains how to cancel an eligible distance contract, obtain return authorisation, return goods and request a statutory remedy for faulty, damaged, incorrect or misdescribed products. You must follow the stated returns process so that we can identify and route the return correctly, but that process does not remove a statutory right validly exercised in time.
Namorra does not provide an extended commercial warranty unless one is expressly stated for a particular product. Applicable statutory protections and our standard customer support remain available.
8. Promotions and discount codes
A promotion or discount is subject to its stated terms, eligibility, period and availability. Unless the promotion expressly permits it, discount codes cannot be combined, exchanged for cash or applied retrospectively. We may refuse or reverse a promotion obtained through error, misuse, manipulation or fraud, provided this does not affect an order already accepted where doing so would be unlawful or unfair.
9. Website availability and changes
We may maintain, update, suspend or withdraw website features where reasonably necessary. We do not guarantee that the website will always be available, uninterrupted or free from every error. This does not affect obligations under an accepted order.
We may change these Terms for future website use and future orders to reflect legal, technical or business changes. The Terms applying to an order are those in effect when the contract for that order is formed, unless a change is required by law or you agree otherwise.
10. Acceptable use
You must not use the website:
- for unlawful, fraudulent or abusive activity;
- to infringe another person’s rights;
- to introduce malicious code or interfere with security, performance or access;
- to scrape, copy or exploit website content in breach of law or our rights;
- to impersonate another person or submit false information; or
- to attempt unauthorised access to accounts, data or systems.
We may restrict or suspend access where reasonably necessary to prevent or address a breach. Serious or repeated misuse may be reported to the appropriate authorities.
11. Intellectual property
The website and its original text, layout, graphics, logos, branding and other content are owned by or licensed to Namorra and are protected by applicable intellectual-property laws. Product and company names belonging to others remain the property of their respective owners.
You may access and use the website for personal, non-commercial shopping purposes. No content may be reproduced, distributed, adapted, republished or commercially exploited without the permission of the relevant rights holder, except where law permits.
12. Reviews and other submitted content
If the website allows you to submit a review or other content, it must be honest, relevant, lawful and must not infringe another person’s rights. Do not submit confidential information, malicious code, unlawful material or content that is threatening, discriminatory, defamatory, obscene or misleading.
You retain ownership of content you submit. You grant Namorra a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it for operating, promoting and improving the store, subject to applicable privacy law. We may moderate or remove content where reasonably necessary, but are not obliged to publish every submission.
13. Third-party services and links
The website may use or link to services operated by others, including payment, delivery, analytics or social-media services. Their separate terms and privacy notices may apply when you use them. We are not responsible for an independent third-party website merely because we link to it, but we remain responsible for our own obligations and for parties where the law treats them as acting on our behalf.
14. Our responsibility
We do not exclude or limit liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights relating to goods, or any other liability that cannot legally be excluded or limited.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was formed, or for business losses arising from a purchase made wholly or mainly for personal use.
If you use the website or purchase products wholly or mainly for business purposes, different legal rules may apply. To the maximum extent permitted by law, we will not be liable for indirect or consequential business loss, loss of profit, revenue, business opportunity, anticipated savings, goodwill or data. Nothing in this paragraph overrides a liability that cannot lawfully be limited.
15. Privacy
Our Privacy Policy explains how personal information is collected, used, disclosed and retained and how privacy rights may be exercised. By using the website, you acknowledge that personal information will be handled as described in that policy and in notices presented at the point of collection.
16. Severability, waiver and transfer
If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.
We may transfer our rights and obligations under an order as part of a business reorganisation or transfer, provided this does not reduce your rights. You may transfer your rights where the law permits or where we agree.
17. Governing law and disputes
These Terms and contracts with Namorra are governed by the laws of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you habitually live.
The courts of England and Wales have non-exclusive jurisdiction. If you are a consumer living elsewhere in the United Kingdom, you may generally bring proceedings in the part of the United Kingdom where you live. Consumers in other countries may also have rights to use their local courts under mandatory law.
We encourage you to contact us first so that we can try to resolve a concern fairly. Please use our Contact Form.
